Friends & Strangers Terms of Use

 

This is some of the legal info we have to post. We know, legal disclaimers and privacy info isn’t exciting stuff, but it is important. It protects you, the User, as well as us. Read it carefully, and you might want to bookmark it. Then go have some fun.

 

These Terms of Service (“Terms”) govern your access to, and use of, the Friends and Strangers websites (“Site”) or any of the component features of the Site (“Features”) and any information including text, graphics, materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). By accessing or using the Services you agree to be bound by the Terms of this agreement. These terms may be changed at any time and without direct notification of the change to users. Check this page frequently for changes.

 

Eligibility

 

  1. Minimum Age: You must be 18 years of age or older to register as a member of the Site or to use any of the Features. Membership to the Site is void where prohibited. By using and/or viewing this site, you represent and warrant that you have the right, authority and capacity to enter into this Agreement. Minors may not become members.

  2. Criminal History: By using the Site Features or registering as a User, you represent and warrant that you have never been convicted of a felony and are not required to register as a sex offender with any government entity. THE SITE DOES NOT CURRENTLY CONDUCT BACKGROUND CHECKS OR SCREEN USERS FOR CRIMINAL HISTORY. However, the Site reserves the right to conduct a criminal background check at any time and using available public records, to confirm your compliance with these Terms.

Termination

 

The Site and all of its Features are provided to you for your use as a convenience, and may be terminated by F&S Media at any time and for any reason or no reason with no notice. Violation of this agreement is grounds for terminating your account. Your account may be terminated by sending you notice to the email address you provided when you completed the User signup process. If you have purchased a membership to the Site, you may cancel the membership within 30 days and receive a full refund for any reason. If F&S Media terminates your membership to the Site due to a breach of this agreement, in the sole discretion of F&S Media, you will not be entitled to any refund of fees, accumulated credits or other value stored within the Site.

 

International Users

 

The Site is operated by F&S Media, located in Las Vegas, NV within the United States of America. F&S Media makes no representation that the services are available in other locations, or that the service complies with the laws of countries other than the United States of America. If you access the Site from other locations, you do so on your own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable. As a User you agree that F&S Media may collect, use and transfer your personal information as described in the Privacy Policy, including transfer outside the country where you live, or where you were physically located at the time you user the Site.

 

Non-Commercial Use

 

The Site is intended solely for the personal use of individual users and visitors only may not be used for any commercial endeavor or application without the written permission of the Site owners. Organizations, companies, and/or businesses may not join the Site and may not use the features of the Site for purpose including, but not limited to: Sending unsolicited commercial messages or advertisements to Users or extracting personally identifiable information for commercial purposes.

 

Membership

 

Your membership, and the user account associated with it, are exclusively for your personal use as an individual. You may not authorize others to use your membership or use your membership for commercial purposes. You may not assign or otherwise transfer your account to any other person or entity. You are responsible for keeping your account secure and you acknowledge that F&S Media is not responsible for third party access to your account that results from theft or misappropriation of your user names, passwords or other verification credentials.

 

Friends and Strangers Rights

 

F&S Media owns and retains all proprietary rights in the Friends and Strangers website including but not limited to trademarks, copyrighted materials, and other proprietary information of F&S Media. Except for information that is in the public domain or that you have been given explicit permission or license to use, you may not copy, modify, publish, distribute, transmit, perform, distribute, display or sell any such proprietary information.

 

Indemnification

 

You are solely responsible for, and assume all liability regarding the information and content you contribute to the Site, the information and content you post, transmit, publish or otherwise make available (hereinafter “post”) through the Site and your interactions with Users of the Site. Users make use of the service at their own risk.

 

Risk Assumption

 

You assume all risk when using the Site. The Site is designed to allow users to meet new people. It is the user’s responsibility to precautions when meeting individuals they have connected with on the Site.

 

Proprietary Rights

 

Friends and Strangers owns and retains other proprietary rights in the Service. The service contains the copyrighted material, trademarks and other proprietary information of F&S Media, and its licensors. In addition, other members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain, or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display or sell any such proprietary information. By posting Content to any public area of the Site, you automatically grant, represent and warrant that you have the right to grant to F&S Media and other Users.

 

Complaints

 

To resolve a complaint regarding Friends & Strangers, you should contact Friends & Strangers support by using the contact form and selecting the appropriate topic.

 

Renewals

 

For users of subscription services, the Site will automatically renew any expiring subscriptions 24 hours before they are due to expire in order to provide uninterrupted service. Renewals are generally for the same term and under the same program as the preceding subscription term. For example, a user who subscribes to the 3-month plan will be renewed for the 3-month plan. By subscribing to a paid subscription of the Site, you agree to and acknowledge that your account will be subject to the above-described automatic renewal billing. If at any time you do not wish to renew your subscription, you must cancel your subscription as outlined in the appropriate section of this agreement.

 

Cancellations

 

Users may cancel their account at any tie by going into the My Account section and selecting the “Cancel Account” button.

 

Users who have purchased a Preferred Membership may cancel within 30 days of their initial purchase and receive a full refund. After the 30 day cancellation period, no refunds will be issued for purchases. Users subscriptions will terminate at the end of the period for which they have paid. In such a case, users subscriptions will terminate at the end of the subscription term for which the user has paid. No refund will be issued for any unused days on the remaining subscription.

 

Links to Third-Party Web Sites

 

The Site may contain links to external websites that are owned and or operated by third parties. The links may include sponsored links, advertisements or links in other forms. The Site is not responsible for the content of these ads or for the content of any of the sites that these ads link to.

 

Controlling Law and Jurisdiction

 

These Terms are governed by the laws of the State of Nevada, without regard to rules generally applicable to resolving conflicts of laws. You agree to both the exclusive jurisdiction and the exclusive venue of the federal and state courts of Nevada, with respect to any claim or cause of action, whether in law or in equity, arising under or relating to these Terms or use of the Service.

 

License to Posted Content

 

By posting information or content to any profile pages or public area of the Site including but not limited to, profile information and pictures, anonymous confessions, missed connections, or other features, you automatically grant, and you represent and warrant that you have the right to grant, to the Site and its users, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, reproduce, publicly perform, publicly display and distribute such information and content, and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing. The Site was created to help users meet new people. The Site will use the content you have licensed in this agreement for activities, promotions and other activities to draw additional visitors and provide suggestions for people users may want to friend. The Site may also expose the licensed content to people who are not registered on the Site to further this goal.

 

Disclaimer of Warranty

 

  1. No Warranties. THIS SECTION WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. EHARMONY PROVIDES THE SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICES OR THE SITE (INCLUDING ALL INFORMATION CONTAINED THEREIN), INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. EHARMONY DOES NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, ERROR-FREE OR WILL MEET YOUR REQUIREMENTS, OR THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED. EHARMONY DISCLAIMS LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, THE CONNECTIVITY AND AVAILABILITY OF THE SERVICES.

  2. Third Party Content. Opinions, advice, statements, offers, or other information or content made available through the Services, but not directly by eHarmony, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. EHARMONY DOES NOT: (i) GUARANTEE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION PROVIDED ON THE SERVICES, OR (ii) ADOPT, ENDORSE OR ACCEPT RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT MADE BY ANY PARTY OTHER THAN EHARMONY. UNDER NO CIRCUMSTANCES WILL EHARMONY BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ANYONE’S RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SERVICES, OR TRANSMITTED TO OR BY ANY USERS.

  3. Beta Features. From time to time, eHarmony may offer new “beta” features or tools with which its users may experiment on the Services. Such features or tools are offered solely for experimental purposes and without any warranty of any kind, and may be modified or discontinued at eHarmony’s sole discretion. The provisions of this Disclaimer of Warranty section apply with full force to such features or tools.

Limitation of Liability

 

IN NO EVENT WILL F&S MEDIA BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMS, SERVICE INTERRUPTIONS AND PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF F&S MEDIA KNOWS OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES WILL F&S MEDIA’S AGGREGATE LIABILITY, IN ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SERVICES OR THE SITE, EXCEED THE PRICE PAID BY YOU FOR YOUR ACCOUNT, OR, IF YOU HAVE NOT PAID F&S MEDIA FOR THE USE OF ANY SERVICES, THE AMOUNT OF US$20.00 OR ITS EQUIVALENT.

 

Online Content Disclaimer

 

Opinions, advice, statements, offers, or other information or content made available through the Friends & Strangers service are those of their respective authors, and not of Friends & Strangers.
